Zusammenfassung
Through historical and legal analysis as well as an empirical study in the French and German speaking regions of Switzerland, this project studies how children and parents understand, experience and respond to what happens to them during child protection proceedings. This project aims to produce knowledge about key features of fair child protection proceedings. Historical analysis provides a record of existing historiographic knowledge about children’s and parents’ experiences of the actions and decisions of child protection authorities (pre-1981 and 1981–2012). Legal analysis studies the long-term development of parents’ and children’s rights in child protection proceedings (1907 – to date) and innovative developments in other countries. The empirical study in French- and German-speaking regions asks how parents and children currently perceive the actions and interventions of Swiss Child and Adult Protection Authorities (CAPAs). A final interdisciplinary phase will develop a draft legislation for a new child protection procedure and accompanying guidelines. The results will be of significance for scientific debate and will raise the awareness of child protection professionals regarding the conditions and settings that encourage and support genuine participation by children and parents. The project will furthermore provide information on innovative, deliberative models designed to facilitate participation in child protection proceedings, and thus help realise the full potential of the interdisciplinary composition of CAPAs in Switzerland.

Ambivalence in Child Protection Proceedings: Parents’ Views on Their Interactions with Child Protection Authorities

Child protection is a field characterized by intrinsic tensions and ambivalence, related to the state’s intervention in the family sphere and to a double mandate of care and control. This article focuses on the participation of parents in statutory child protection proceedings and the ambivalence they experience in their interactions with the Child and Adult Protection Authority in Switzerland (CAPA). The aim is to explore parents’ views on what they consider as hindering or enabling in their interactions with the CAPA in order to be able to fully participate in child protection proceedings. The article is based on a large interdisciplinary research project including multi-perspective cases collected in four cantons of Switzerland and puts the focus on in-depth interviews with ten birth parents. Results show that ambivalence is inherent to the interactions between parents and the CAPA, as the mere opening of child protection proceedings is experienced as a threat to the parents’ integrity. Establishing trust, recognizing parents’ expertise and acknowledging their needs are key to re-establishing parental integrity, which seems to be a fundamental pre-requisite for reducing ambivalence and enhancing participation in child protection proceedings.

Participation of Children and Parents in the Swiss Child Protection System in the Past and Present: An Interdisciplinary Perspective

As in other European countries, the Swiss child protection system has gone through substantial changes in the course of the 20th century up to today. Increasingly, the needs as well as the participation of children and parents a ected by child protection interventions have become a central concern. In Switzerland, critical debates around care-related detention of children and adults until 1981 have led to the launch of the National Research Program ‘Welfare and Coercion—Past, Present and Future’ (NRP 76), with the aim of understanding past and current welfare practices. This paper is based on our research project, which is part of this national program. We first discuss three overarching concepts—integrity, autonomy and participation—at the heart of a theoretical framework in order to understand the position of parents and children in child protection proceedings. Secondly, we critically analyze the historical and legal development of the child protection system in Switzerland and its e ects on children and parents from 1912 until today. Thirdly, we give an insight into the current Swiss child protection system, with an investigation of hearings of parents and children conducted by the Child and Adult Protection Authorities (CAPA) based on participant observations. In particular, we show the importance of information exchanges and of signs of mutual recognition. Finally, in light of our findings, we discuss the interplay between socio-historical and legal developments in child protection and their consequences for the integrity, autonomy and participation of the people involved.

Fachliches Urteilen, Körper und Sinne. Analytische Reflexionen am Beispiel von Hausbesuchen und Anhörungen im Kinder- und Erwachsenenschutz

Während sowohl die Ethnografie als auch die Praxistheorie vom physischen Vollzug sozialer Situationen ausgehen, sind körperleibliche und sinnlich-affektive Dimensionen von Entscheidprozessierungen in ethnografischen Forschungen bisher noch wenig beleuchtet. Der Beitrag führt Entscheiden als prozesshafte, sozial situierte und verkörperte Praxis ein und rekapituliert anschließend den Stellenwert von Körpern und Sinnen für die Praxistheorie. Danach folgen empirisch-analytische Ausführungen: Die Bedeutung sinnlich-affektiven Wahrnehmens und körperleiblichen Spürens für Entscheidprozessierungen explizieren wir am Beispiel von Hausbesuchen und von Anhörungen – und damit anhand von zwei unterschiedlichen Situationen des zivilrechtlichen Kinder- und Erwachsenenschutzes, die in der Regel die physische Kopräsenz von Fachkräften und betroffenen Personen erfordern. Zum Schluss diskutieren wir, was (sinnes-)ethnografische Zugänge für die Erforschung der körperleiblichen, sinnlich-affektiven Dimension von Entscheidprozessierungen leisten können und welche Fragen offenbleiben.

Eingriffe in Familien früher und heute: Historische Beispiele von Kindswegnahmen und Einblicke in ein laufendes Forschungsprojekt zur aktuellen Kinderschutzpraxis in der Schweiz

Aline Schoch und Brigitte Müller von der Hochschule für Soziale Arbeit FHNW, Muttenz/Schweiz geben einen Einblick in ein aktuelles Forschungsprojekt in der Schweiz, das eine vergleichende Analyse von Eingriffen in Familien früher und heute durchführt und historische Beispiele von Kindswegnahmen mit der aktuellen Kinderschutzpraxis in der Schweiz kontrastiert. In den Forschungen zur Aufarbeitung fürsor-gerischer Zwangsmaßnahmen und Fremdunterbringungen in der Schweiz wird in ganzer Deutlichkeit klar, mit welchen erheblichen Traumatisierungen und Benachteiligungen die Personen leben mussten, die im Lauf ihrer Kindheit, Jugend oder auch erst im Erwachsenenalter Opfer der rückblickend als willkürlich und schädigend zu bezeichnenden schweizerischen Fürsorgepraxis wurden. Kontrastierend zu den historischen Befunden werden aktuelle Ergebnisse eines laufenden Forschungsprojektes zu der Frage, wie Kinder/Jugendliche und Eltern Kin-derschutzverfahren und Begegnungen mit den Kindes- und Erwachsenenschutzbehörden KESB wahrnehmen und darauf reagieren, vorgestellt.
